Last week, Rahul Gandhi travelled to a corner of eastern Uttar Pradesh
to get a feel of the "hawa" — the direction of the wind — on the eve
of launching the Congress party's campaign for state elections that
will be held in the next few months.

With roughly 170 million people, making it India's most populous
state, Uttar Pradesh and its state assembly of 403 seats has often
been viewed as a bellwether for which party will rule all of India.

But for more than 20 years, Congress has been lost in Uttar Pradesh's
political wilderness, as caste and identity politics held sway. Now,
smelling criticism of the Chief Minister Kumari Mayawati's four-year
tenure, and of her Bahujan Samaj Party, Congress is pulling out all
the stops.

That is why Mr. Gandhi, a Congress general secretary who commands
instant name recognition by virtue of being a member of the
Nehru-Gandhi dynasty, has been slated as the party's star campaigner.
The trip to eastern Uttar Pradesh, said a Congress official, was a
signal both to the state Congress leadership as well as to party
leaders in the federal government that Congress is serious about
putting up a fight against Ms. Mayawati.

"The party has divided UP into 10 zones, allocating each to key party
leaders. Rahul-ji has made it clear that since they wield power in the
federal government, they must also have connections on the ground,
which means that they have to deliver by improving the party's
prospects," the Congress official said. "Today, we only have 22 seats
in UP, but if we fight hard we should get between 80 to 100."

The official acknowledged that Congress was still severely hampered by
a lack of good, provincial leaders. Then there is the matter of caste,
an extremely powerful tool in an era of caste-identity politics which
Ms. Mayawati, a Dalit leader, has exploited brilliantly in the past.

Congress, the official said, is now trying to recover lost political
ground by creating alliances between Dalits, Muslims and upper-caste
Brahmins, as it once did in its heyday. "We certainly won't win the
election, but we must at least show the people that we are a credible
alternative," the Congress official added.

That is why Mr. Gandhi, on his visit, paid obeisance at the Varanasi
temple of Sant Ravidas, a beloved saint of the Jatav sub-caste within
the Dalit community. In Harsinghpur village, in nearby Mirzapur
district, he met Hindu and Muslim weavers, also considered to be part
of the low-caste pantheon, as well as the widow of a man whom locals
said had jumped into the flowing Ganga nearby in order to escape from
policemen demanding bribes.

As part of its broad strategy to woo Dalits, the Congress-led
government in Delhi last week made it mandatory for departments to
procure at least 4% of their goods annually from Dalit and
tribal-owned small-scale industries.

"We welcome this initiative. Everybody has been talking about
inclusive growth for such a long time, this is the first step," said
Milind Kamble, president of the Dalit Indian Chamber of Commerce and
Industry.

It may be politically driven, but Chandrabhan Prasad, Dalit writer and
intellectual, said that wasn't the point.

"Politics is about governance and the right to rule. If people say
this is a conspiracy to woo Dalits on the eve of the elections in
Uttar Pradesh, I say, this is a good conspiracy," he told India Real
Time. "After all, democracy is all about give and take. This milestone
decision will do more for the Dalit community than reservations and
quotas have done for us since independence."

Several Dalit political scientists agreed that the Congress party's
move to purchase Dalit goods was shrewd, if limited. It reflects a
changing perception of the community, from one needing perpetual
handouts to one willing to participate in the market economy, noted D.
Shyam Babu, a Dalit political scientist.

Ambika Soni, information and broadcasting minister in the federal
government, said in an interview that Congress is confident of making
an impact in the state.

"I think things are changing on the ground. Mayawati will not do as
well as before," she said. "Just look at her track record. The UP
polls will be a big surprise."

BSP leader Ambeth Rajan dismissed Congress's efforts and laughed off
the prospect of a serious challenge.

"We will sweep the polls, you will see. Rahul only has potential,
nobody has seen what kind of a leader he actually is," Mr. Rajan told
India Real Time. "He has only won his own election so far, the party
has not benefitted from him so far. In fact, the Congress doesn't even
have good candidates in UP."

Still, a different BSP leader acknowledged that the reality on the
ground was "far more fluid" than any party would admit. He said
nonetheless that the BSP would win the elections, not only because the
Congress was still not a real alternative but because Dalits still
feared the return of Samajwadi Party leader Mulayam Singh Yadav
because of the inter-caste violence unleashed during his earlier
tenure.

Ultimately, the question may be best posed not as whether Congress can
win but how tightly Ms. Mayawati can hold onto her core Dalit
constituency now and in the years ahead.

Surinder Jodhka, political analyst and professor of Dalit studies at
Jawaharlal Nehru University, told India Real Time that the biggest
challenge to Dalit leaders like Ms. Mayawati is the growing divisions
within the Dalit community itself.

"Mayawati is a very smart politician, other politicians in UP are not
as smart as her," he said. "However, as a result of the dynamics of
the reservation system, several sub-castes within the Dalits are
moving away from her. This is a challenge. Question is, can opposition
parties like the Congress take advantage?"

Don't shift Ambedkar statue, say Dalit students
Bangalore, Nov 3, DHNS:

More than hundred dalit postgraduate students of Bangalore University
on Thursday protested at the Mysore Bank Circle against the Bangalore
Metro Rail Corporation's (BMRC) move to shift B R Ambedkar's statue
from the Vidhana Soudha premises.

Earlier this week, BMRCL MD, N Sivasailam had written to the State
government stating that the Corporation will need an additional Rs 100
crore if the statue is not moved.

G Govindaiah, pursuing his MA in History, led the protest. He claimed
that if need be, the students will ensure that the dalit community
contributed Rs 100 crore.

"Students of BU and dalits across the State are willing to contribute
Rs 100 crore, but we will not let anyone touch the statue of
Ambedkar," Govindaiah said.

"A project worth Rs 12,000 crore can easily take an additional cost of
Rs 100 crore. Also, BMRCL can easily find alternative ways to go about
constructing the station," added another student, Sathyamurthy.
However, both Sivasailam and BMRCL PRO B S Chavan refused to comment.

The Ambedkar statue is surrounded by boulders which require to be
blasted. Sivasailam had earlier stated that it was for the good of the
statue that they planned to shift it as blasting may damage the
statue.

Uttar Pradesh chief minister Mayawati's move to divide the state into
four parts is being seen by her supporters as a masterstroke ahead of
the 2012 assembly polls.

LUCKNOW: UP chief minister Mayawati is likely to announce the
reorganization of Uttar Pradesh, splitting the sprawling state into
four parts, in a move that her supporters are seeing as a poll-eve
masterstroke.

Well-placed BSP sources said Mayawati is planning to carve four new
states out of the country's largest state which, with its 75
districts, is larger than many countries. As per the blueprint, the
eastern part of the state with 32 districts will form a new state of
Poorvanchal while the 22 western districts will be grouped together as
Harit Pradesh. Bundelkhand will take seven districts while the
remaining 14, all in central UP, will comprise the fourth.

Mayawati did not deny the move when questioned by reporters at a press
conference to announce the hike in state advisory price for sugarcane.
A smiling Mayawati said, "It's a big issue but I will not talk about
it today because if I do, you people will downplay the SAP story, a
big pro-farmer step of the state government." This response
strengthened the buzz around the reorganization.

A division of UP has been talked about for long because of the
problems involved in administering such a large area. The state
remains unwieldy even after the hilly region was hived off to form
Uttarakhand.

But the move has gained momentum now because of the impending
elections, with BSP sources hoping that it would set the agenda for
the coming polls, while diverting attention away from the incumbency.

Parties wary of Maya's move to divide state ahead of polls

The hope is not without basis because almost all political parties
have at various times advocated division of the state into smaller
units. Congress has been championing the creation of Bundelkhand on
the ground that its distance from Lucknow has contributed to its
backwardness. The party has not taken a stand on Harit Pradesh, but
will find it difficult to oppose it because its prospective ally Ajit
Singh has made it a battle theme.

BJP, which carved Uttarakhand out of UP, has consistently prided
itself for its commitment to smaller states -- pointing to the
creation of Chhattisgarh and Jharkhand in 2000. The party has now
taken cudgels for the demand for Telangana.

Samajwadi Party is categorical in its opposition to the splintering
plan. Its general secretary Ram Gopal Yadav said, "The division will
reduce UP's clout in national politics." BSP sources feel that SP's
opposition will help Mayawati's plan to shape the narrative.

Under the Constitution, the power to create new states is vested with
Parliament. Constitution explains that the bill for creation of new
states can be introduced in either House of Parliament on the
recommendation of the President. If the bill affects the area,
boundaries or names of any of the states, President would refer the
bill to the legislature of the state for expressing its views within a
stipulated period.

The Congress, which is already caught in the row over separate state
of Telangana, is unlikely to reveal its hand. Congress leaders said
the party might support Mayawati's proposal but a final decision would
be taken by the high command. In New Delhi, Congress did not oppose
the move outright, merely saying it should be referred to a new State
Reorganization Commission: a posture which only indicated its wariness
of Mayawati's electoral intent.

Although her timing has been influenced by the looming polls, Mayawati
has kept the issue burning since winning the 2007 elections. She
publicly supported the division of UP while addressing a rally in
Lucknow, and followed that by writing to Prime Minister Manmohan Singh
in 2008 and, again, in 2009. Most recently, she raised it in September
while announcing the creation of three new districts in western UP.

Even as bigger players were trying to craft their response, smaller
outfits campaigning for statehood for distinct regions in UP were
already celebrating the prospect. "We are getting support of the
National Federation for New States, which includes outfits fighting
for small states across the country," said Raja Bundela of Bundelkhand
Congress.

Former SP leader Amar Singh also announced that he would hold a rally
on November 13 at Sarnath in Varanasi in support of the creation of
Poorvanchal. Their excitement can only serve Mayawati's objective to
distract attention.

The BJP has been supporting smaller states but has chosen to downplay
Mayawati's proposal. BJP's national vice-president Kalraj Mishra said
the party had always been in favour of smaller states but the decision
to divide UP should be taken after a thorough study by state
reorganization commission.

He also said BSP should make it clear whether it had any specific plan
for trifurcation or was raising the issue only to arrest
anti-incumbency and divert public attention from the corruption and
breakdown of law and order under Mayawati's rule. BJP state president
S P Shahi said, "We will open our cards after the state government
tables the proposal in the state assembly."

With an eye to the 2012 assembly elections, Uttar Pradesh Chief
Minister Mayawati Tuesday announced a steep hike in the sugarcane
purchase price, making it the highest in the country.

"We have decided to increase the sugarcane price by Rs40 per quintal
for the forthcoming crushing season commencing next week," the chief
minister told a press conference here.

Clearly targeting the four million sugarcane growers, she said: "The
state advised price (SAP) for the average variety of sugarcane for the
new crushing season has now been increased from Rs205 per quintal to
Rs245 per quintal."

Claiming that this was the highest sugarcane price fixed by any state
government in the country, she said: "For the early yielding variety
of sugarcane, the price would be still higher at Rs250, while that for
the late yielding variety has been fixed at Rs235."

To make the farmers even happier, the chief minister sounded a warning
for each of the state's 126 sugar-mill owners (including 23
cooperative sector mills) and said: "Start your crushing as per
schedule or else be prepared to face the music."

"The Bahujan Samaj Party (BSP) government has always been committed to
the cause of the farmers," she said. "That was the reason I did not
hesitate to put owners of sugar mills behind bars who had not cared to
start crushing on time."

Drawing a comparison between the previous regime headed by Samajwadi
Party chief Mulayam Singh Yadav, she said: "... when I took over the
reins of the government from Mulayam Singh Yadav in 2007, the
sugarcane price was as low as Rs125 per quintal. We have given a
quantum jump and nearly doubled the price of sugarcane, which reflects
our commitment to the cause of sugarcane farmers."

Uttar Pradesh, which remains the largest sugarcane producing state in
the country, is also the second largest producer of sugar. In
2010-2011, the state produced 1,200 lakh tonnes of sugarcane, while
sugar production stood at 59 lakh tonnes.

HYDERABAD: Calling upon the Congress and TDP to emulate Uttar Pradesh
chief minister Mayawati's decision to introduce a resolution in the UP
Assembly on the bifurcation of UP into four smaller states, the
Telangana Rashtra Samithi on Tuesday demanded that both the parties
respect popular public opinion in the region by passing a resolution
in the AP Assembly in support of Telangana state during the winter
session.

Welcoming Maywati's initiative, Sircilla legislator K Taraka Rama Rao
said the decision to bifurcate UP further into four smaller states -
Purvanchal, Harith Pradesh, Awadh and Bundelkhand for administrative
convenience reflected a popular CM's sincerity in respecting public
sentiment and perception. "Her desire to ensure equitable share in
governance to all sections of the society in accordance with the ideas
of the founder of Indian constitution Babasaheb Ambdekar are laudable.
Mayawati's determination to create smaller states should be an
eye-opener to both chief minister N Kiran Kumar Reddy and opposition
leader N Chandrababu Naidu," he said.

Rao accused the Congress party of dragging its feet on the issue and
said it is sad that Congress leaders have been trying to create a
controversy by stating that any such move by Mayawati would result in
the Centre linking both the issues and announce the constitution of a
second States Reorganisation Commission (2nd SRC).

Cautioning Congress party against toying with the idea of a second SRC
at this decisive hour, the TRS said it would ensure that Congress is
wiped out of the political arena in the region if it does not put an
end to the delay-tactics on the formation of T state. "We demand the
Centre to honour its Dec 9 announcement on Telangana," he said.

A votary of smaller states, Mayawati is said to have launched the
bifurcation move in a bid to floor her three main political opponents
-- Congress, Samajwadi Party and BJP during the March 2012 elections
to the UP assembly. She is said to be keen on introducing a resolution
to that effect in the Uttar Pradesh Vidhan Sabha on Nov 21. Uttar
Pradesh is not only India's largest state, but also the world's sixth
largest administrative unit.

price for different varieties of sugarcane for the season 2011-12. The
average increase as compared to the previous season is Rs 40 . The
move is being viewed as an attempt to woo a large farming community in
the state.

Talking to media persons immediately after taking the decision at a
cabinet meeting, the chief minister said that the price announced by
her was more than Rs 230 per quintal announced by the Punjab
government and Rs 145 per quintal fair and remunerative (FRP) for
sugarcane announced by the by Central government.

The decision, she added, would benefit over 40 lakh cane farmer
families in the state. She said that some sugar mills in the western
UP had started crushing cane and remaining would start in next three
days. She has also issued directions to officers to take strict action
against mills which refuse to buy cane at SAP and if there are
complaints about under weighing of cane by mills. Last year, Mayawati
said, two mill owners were arrested for laxity in crushing and delay
in payments to farmers and the government would not hesitate to do so
again.

The CM said the new price has been revised as: Rs 240 per quintal for
common variety as against Rs 205 per quintal last year. For the early
maturing variety, the SAP goes up from Rs 210 per quintal to Rs
250/per quintal and Rs 235 for late maturing variety.

With this, the total payment by mills to cane farmers for their
produce is expected to go up to around Rs 15,000 crore this year as
compared to that of Rs 13,000 last year. Likewise, UP is also
confident of increasing its sugar production this year to 62 lakh
tonnes as compared to 58.7 lakh tones last year.

"We have done to the best of our ability protect the farmers' interest
and the prices fixed are both in the interest of the cane growers and
sugar cane industry," the CM said. Taking credit for her government to
double the cane prices during her rule since 2007, she said that
during the Mulayam Singh Yadav's regime the cane price was Rs
125/quintal. "But we have almost doubled SAP to Rs 250/quintal, as we
work for the benefit of farmers."

Farmers had demanded the state advisory price of cane at Rs 275 to Rs
290/per quintal in view of the rising cost of agricultural inputs,
including fertilizers and other raw materials. But this was opposed by
sugar mill owners, who said that sugar production would become
unprofitable and the Industry would become sick if the SAP was
increased under farmers' pressure.

This posed a dilemma before the state government and delayed its
decision to announce the SAP, even though the sugar crushing season
had started and farmers were getting desperate to sell their produce.
They were desperate as they needed their field vacant in time to catch
up with the rabi sowing season.

Reacting to the increase, director general of the Indian Sugar Mills
Association Abinash Verma said the production cost of sugar would go
up by the revised price and this would cause loss to the mills. The
only way out, he said, was export. That could help mills compensate
for the escalating prices to be paid to farmers.

The nervousness among the mill owners is evident. Even though the cane
crushing season has started, mill operation remains at a snail's pace.
Only 24 out of the 120 odd sugar mills in the state have so far
started crushing.

Kisan Jagriti Manch president Sudhir Panwar said "Even after this
hike, farmers will be in loss. As per UP Council of Sugar Cane
Research, Shanjahanpur, the input cost increased this year by 34.5%
(last year it was Rs 139/quintal while this year Rs 187/quintal) while
increase in SAP is only 17% (last year it was 205 for normal variety
while this year it is Rs 240). "

Bhartiya Kisan Union (BKU) general secretary Rakesh Tikait, said, now
government should ensure that mills start crushing cane as early as
possible. He blamed Central government for low SAP. "The Congress led
UPA government announced FRP Rs 145 per quintal. Mill owners are
arguing that since price (FRP) announced by Centre is 'fair and
remunerative', there is no need for the state government to fix SAP.
The mill owners may also challenge state government's decision in the
court," he said.

Farmer leader associated with Congress party, VM Singh: "The state
advisory price of Rs 235-250 per quintal by UP government is very low.
Last year farmers got up to Rs 260 per quintal.

In one year, the input cost of farmers has increased by 60% due to
increase in cost of labour, diesel and fertilisers."

Dalit leaders expressed acute contempt over the delay in solving the
Venur atrocities case.

During the SC/ST grievances meet held on Sunday at SP Office in
presence of Superintendent of Police Labhu Ram, Dalit leader Shekar
calling the incident nothing less than an atrocity said that the lady
in question was cheated by a man promising her marriage. He however,
abandoned her without marrying her. The lady gave birth to a baby on
September 10, 2011 in a hospital in Mangalore. Though a case was filed
couple of months ago, the police have not been able to nab the
culprit.

Responding to the same, Investigation Officer, Additional SP
Prabhakar, said that it is wrong on the part of the community members
to say that the police has not done
its duty or is unnecessarily delaying action against the culprit.

"We are on a look out for the culprit who is absconding since a long
time now. On receiving some information, we had even sent team to
Mumbai to track him down, but it was in vain," he said adding that
once the culprit is nabbed, then there is a long procedure of
collecting DNA samples of both the culprit and the baby and receiving
report to see if the samples match. However, collection of details is
going on, said Prabhakar.

Dalit Leader Keshava said that Scheduled Caste families living on 1.80
acre land at Barya village have been left in lurch because attempts
are now on to evict them from this land.

"The land was allotted for Dalits in 1979 but the sanction was
cancelled in 1983. Now some vested interests are trying their level
best to get the Dalit families out of this place," he said adding that
the Dalit families have the right over this land and this right must
be restored.

Responding to this, the SP said that he will direct the Tahshildar
concerned to take up re-survey of the land at the earliest.

Leader S P Anand said that though the grievances meet to be held by
the police department is being conducted regularly, the meeting to be
conducted by the Deputy Commissioner has not been held. "There are a
lot of issues which needs to be brought to the notice of the DC. The
relief available to the Dalits under Atrocities Act, which ranges from
Rs 25,000-50,000, has been reduced to Rs 5,000. This should not have
happened," he said adding that the applications for subsidy for self
employment applied to Ambedkar Welfare Board are not being issued on
time to the applicants.

Hyderabad, Nov 4: The All India Dalit Women's Rights Protection
Society has demanded that the State government immediately arrest the
minister Dr P. Shankar Rao, who was brain behind the assault on
Industries department Joint Director A.V. Patel on October 21.

Speaking to mediapersons here on Friday, the society secretary P.
Suhar Latha demanded that Chief Minister N. Kiran Kumar Reddy
immediately dismiss Dr Shankar Rao from the Cabinet and order a CBI
inquiry into his assets. She alleged that Dr Shankar Rao had
pressurized the Principal Secretary of Industries T.S. Appa Rao to
illegally transfer Joint Director A.V. Patel. She also demanded that
the government order an inquiry against an anti-Dalit officer,
Principal Secretary T.S. Appa Rao's assets, irregularities in subsidy
funds in Industries department and promotions. She said that the
Vigilance department had submitted a report to the government that
irregularities had taken place in the department.

She also criticized the Chief Minister for failing to take action
against Dr Shankar Rao even after submitting memoranda on the
official's illegal activities. She said that along with Dr Shankar
Rao's victims, they would organize a dharna at Jantar Mantar, New
Delhi shortly demanding that the Chief Minister sack Dr Shankar Rao.

The society president Ratna was also present.

Poetry of truth prospers in India's lifestyle angst

A genre of realistic poetry in English is seeking the unbridled
literary creativity and beauty of the medium to beat the lifestyle
angst - and connect to spirituality, politics and roots in India's
growing modern jungles.

The internet is India's new poetry workshop. Over a dozen portals
dedicated to young poetry helps budding writers post their poetry to
readers. The writers vary in profile - from the young college student
under pressure to the harassed professional.

English poetry in India made a milestone journey in the first few
decades of the 20th century when an early generation of Indo-Anglian
poets, with exposure to foreign education and life, documented their
Indian experience in realistic verses. It moved away from the
ornamental sonnets of love and pining - a legacy of a bygone
Wordsworthian ethos that reigned in the greater part of 19th century
poetry.

The two World Wars and the struggle for i ndependence influenced the
sensibilities of modern Indo-Anglian poets, colouring the verse with a
measure of aggression and a personalised angst. And also a sense of
freedom.

"Poetry helps me reconnect to my roots in Malabar... it marks a return
to my carefree childhood days," poet and novelist Anita Nair, whose
debut anthology "Malabar Minds" conjures up the magic of the land to
which she owes her allegiance, told IANS.

Nair says she deals "with the sensuous existence that she identifies
with Malabar - and of youth and human emotions".

The poems read like travelogues following the landscapes and
mindscapes of a turf where life flows like lazy afternoons - in the
odd toddy vends and on the beaches, in the midst of nature, buses and
everyday concerns.

For young Dalit feminist poet Meena Kandaswamy from Tamil Nadu, poetry
is a tool of rebellion against the system and the "oppression that
young Dalit women still face in contemporary India".

"You have to accept my poetry as it is. It is the only language I
know," Kandaswamy says of her poetry laced with sexual innuendos and
spiritual imageries.

Kandaswamy, often hailed as one of the fieriest petrels of the new
Indian poetry, reinterprets characters like Draupadi, Sita or Kannagi
as rebels "who refuse to collude with patriarchy".

According to poet Ranjit Hoskote, "In Kandaswamy's poetry (in the
anthology 'Ms Militancy'), there is an element of
self-dramatisation... a result of an acute self-consciousness of
having to address the pressures of perception that attend poets, women
and poets, who happen to be women".

Hoskote's poetry, on the other hand, threads itself to a personal
element which draws from spirituality and the genres of art that he
explores in his dual life as an independent art critic and curator.

He started publishing poetry in the 1990s and has translated works of
several foreign and Indian language poets.

Late poet Agha Shahid Ali had observed: "Hoskote wants to discover
language as one would a new chemical in a laboratory experiment."

"This sense of linguistic play, usually missing from sub-continental
poetry in English, is abundant in Hoskote's work," said Ali, a
renowned Kashmiri poet who began to publish in the 1970s and used his
poetry to chronicle accounts of personal events and sometimes
political.

One of his long poems, "Kashmir Without a Post Office", acclaimed
worldwide, gathers material from the 1990 uprising in the valley and
its violent political consequences.

The generation of 20th century modern pioneers, which includes legends
like Rabindranath Tagore and Michael Madhusudan Dutt, came to be best
represented later by Sarojini Naidu, Toru Dutt, Nissim Ezikiel, P.
Lal, Jayant Mahapatra and Dom Moraes.

Since then, every generation has witnessed a new wave of poetry. While
the 1960s and 1970s were characterised by poetry of rebellion, the
decades between 1980s and2000 have seen love - of a bolder kind - and
new oppression return to the creative space.

John Oliver Perry, a former emeritus professor of English in the US,
who conducted regular studies in India in 1971, notes "that unlike a
poet in English-dominant cultures, an Indian English poet stretches
his or her linguistic resources (and those of his indigenous readers)
far beyond what is enlisted in their common everyday life".

Public Procurement Policy for Micro and Small Enterprises: A Perspective

BACKGROUNDER


The Micro and Small Enterprises (MSEs) constitute an overwhelming
majority of this sector, contributing significantly to the gross
domestic product, manufacturing output, exports and employment
generation. Among registered MSEs, 10.73% are owned by SC/ ST
entrepreneurs, 38.7% by OBCs and 13% by Women entrepreneurs (as per
IVth Census of MSMEs).

MSEs are highly susceptible to volatile market conditions. To address
this inherent problem, many countries in the advanced world have put
in place public procurement policies to support MSEs and to ensure a
fair share of market to such entities, for example, in USA, a minimum
of 23% from Small Businesses is legislated. Under the existing
dispensation in India, the Government guidelines provide for support
in marketing of MSE products through a variety of measures such as
price preference, reservation of products for exclusive purchase from
MSEs, issue of tender sets free of cost, exemption from payment of
earnest money, etc. In practice, however, these guidelines are not
being followed many Government Departments/ CPSUs, etc in true spirit.
Therefore, there was a need for an effective policy which mandates the
Central Govt. Deptt. /CPSUs to procure necessarily from MSEs.

Ministry of MSME has formulated Public Procurement Policy for MSEs
which has been approved by the Cabinet.

The Salient features of the Public Procurement Policy are as under:

Every Central Ministry/Department/PSU shall set procurement goal
of minimum 20 per cent of the total annual purchases of the products
or services produced or rendered by MSEs.
Out of 20% target of annual procurement from MSEs, a sub-target of
4% (i.e., 20% out of 20%) will be earmarked for procurement from MSEs
owned by SC/ST entrepreneurs.
The overall target of 20% is proposed to be made mandatory at the
end of 3 years.
For enhancing the participation of SCs/STs in the Government
procurement, the Central Government Ministry/Department/PSUs will
organise special Vendor Development Programmes, Buyer-Seller Meets
etc.
Every Central Government Ministry/Department/PSU will report the
goals set with respect to procurement to be met from MSEs and the
achievement made thereto in their Annual Reports.
The MSEs participating in a tender quoting price within the band
of L1+15% may also be allowed to supply at L1 price where L1 price is
from someone other than an MSE. Such MSEs may be allowed to supply up
to 20% of the total tendered value. In case of more than one such
MSEs, the supply will be shared equally.
The Central Ministry/Department/Public Sector Undertaking will
continue to procure 358 items from MSEs, which have been reserved for
exclusive purchase from them.
Given their unique nature, defence armament imports will not be
included in computing the 20% goal for M/o Defence. In addition,
Defence Equipments like weapon systems, missiles, etc. will remain out
of purview of such policy of reservation.
A Review Committee has been constituted under the chairmanship of
Secretary (MSME) for monitoring and review of the Public Procurement
Policy for MSEs. In addition, a 'Grievance Cell' would be set up in
the Ministry of MSME for redressing the grievances of MSEs in
Government procurement.

The policy will help to promote MSEs by improving their market access
and competitiveness through increased participation by MSEs in
Government purchases and encouraging linkages between MSEs and large
enterprises.

A Broader Outlook:

Given the present global situation of an impending or even
continuing economic slowdown, creating demand within our own vast
market for products produced by our own industries, would be a good
buffer to ward off the negative impact. With assured public
procurement, the MSE sector has only itself as a competitor among its
vast variety of products. It will not only encourage better marketing
strategies but also an incentive for new designs and technologies so
that their produce can compete even in international markets. This
will also have a stabilizing effect on market fluctuations of demand
and supply and liquidity crisis. With MSEs great employment
generation potential, the new procurement policy will be a boost to
keep generating new products with mostly locally available resources
both in material and manpower. Thus with a substantial section of
national economy in good spirits, government will have its hands
strengthened to chalked out policies to deal with the impact of global
economic crisis.

Growing modernisation and migration of people across the country has
forced the Supreme Court to change the rules for determination of
caste status of Scheduled Castes and Tribes.

In a judgement delivered on Tuesday, the Supreme Court held that if a
person fails to show affinity to the traditions, customs and practices
of his ancestral community, caste or tribe, his caste/tribe claim
cannot be discounted if there is documentary evidence to prove the
same.

It said, "The affinity test may not be regarded as a litmus test for
establishing the link of the applicant with a Scheduled Tribe.
Nevertheless, the claim by an applicant that he is part of a Scheduled
Tribe and is entitled to the benefit extended to that tribe, cannot
per se be disregarded on the ground that his present traits do not
match his tribes' particular anthropological and ethnological traits,
deity, rituals, customs, mode of marriage, death ceremonies, method of
burial of dead bodies, etc."

The bench of Justices DK Jain and AK Ganguly passed this order while
deciding the appeal filed by one Anand, a resident of Maharashtra, who
claimed to be from Halbi Scheduled Tribe. The Committee for Scrutiny
and Verification of Tribal Claims, Amravati, however, rejected his
claim, a decision that was subsequently upheld by the Nagpur bench of
Bombay High Court on May 5, 2004. Following this, Anand approached the
court.

Reversing the HC order, the SC bench said, "A few decades ago, when
the tribes were somewhat immune to the cultural development happening
around them, the affinity test could serve as a determinative factor.

communities, these communities tend to develop and adopt new traits
which may not essentially match with the traditional characteristics
of the tribe."

The court relied on the fact that Anand possessed documentary proof to
substantiate his claim. Holding this to his advantage, the bench laid
down broad parameters to decide on validity of caste or tribe claims.

Dispose of SC,ST atrocities cases quickly: Collector

Nellore: The District Collector, Mr B Sridhar, said on Thursday that a
special meeting would be convened to examine cases related to
atrocities on SCs/STs filed at the division level. He participated in
a review on atrocities cases at the Jubilee Hall here.

He asked the officials concerned to render justice to SCs and STs by
solving cases related to land and property disputes as well as
attacks.

Mr Sridhar instructed police and revenue officials to work in
coordination for tackling cases pertaining to atrocities on SCs/STs.
So far, 578 cases had been solved in courts and 544 cases had been
struck down, while the accused had been punished in 34 cases, he
remarked. He pointed out that 195 cases were under enquiry at SC, ST
Court from a total of 292 cases filed.

In all, 97 cases were pending with the magistrate. The collector
stated financial assistance totaling Rs 7.87 lakh had been sanctioned
to 64 victims.

Steps were being taken, with the support of revenue, police and social
welfare officials, to rehabilitate victims and provide financial
support to SCs and STs so as to to implement the Atrocities Act in
true spirit.

The Gudur MLA, Mr Balli Durgaprasad, urged the collector to register
FIR immediately against those involved in attacking SCs/STs. The
Venkatagiri MLA, Mr K Ramakrishnaiah, the Superintendent of Police, Mr
Ramana Kumar, Additional Joint Collector, Mr Laxmikantham, and other
officials were
present.
