Madurai lawyers seek action on judge

A group of lawyers, many of them dalits, has demanded action against
Justice C.S. Karnan accusing him of using the dalit card to promote
his own interests. They alleged that the judge had functioned in an
anti-dalit manner while disposing of some cases in his court.

"His dalit identity is just a façade. The judge had adopted an
approach inimical to the dalit victims in some cases," P. Rathinam,
leading the group of advocates, told reporters here on Friday. He
released copies of a memorandum the lawyers' group had sent to the
chief justice of the Madras high court pleading for action against
Justice Karnan.

According to Mr Rathinam, the judge had threatened to initiate
contempt proceedings against a lawyer when he appeared for a dalit
victim allegedly assaulted by the head of a Madurai-based NGO and his
family members.

When the advocate replied that he was only discharging his duty as a
counsel, Justice Karnan reacted saying contempt proceedings should be
initiated against him for interfering unnecessarily (in the case).
This incident figured in the lawyers' petition to the chief justice.

In that petition of October 20, they said, "Contempt proceedings
should be initiated against the judge for threatening the lawyer in
the open court. We also request the Chief Justice not to allot
judicial work to him". The petition also alleged that the judge had
granted bail 'liberally' on various matters.

Pleading for action against the judge, the lawyers said his hesitation
to name the judges, who according to him had humiliated him because he
was a dalit, was "only tactics to safeguard himself from the charges".

Justice Karnan had recently filed a complaint with the National
Commission for SC/ST alleging that some brother and sister judges had
humiliated him just because he was a dalit.

ROHTAK: After much hullabaloo in Bhiwani over the high profile
inter-caste marriage of IFS officer Neelam Sharma with IAS officer
Kuldeep Yadav, the groom told TOI that there never was any controversy
about their marriage.

He said the bride's family has been particularly very hurt since "the
media has blown the issue out of proportion." Meanwhile, residents of
his village Baldhan Kalan in Rewari district were enthused about the
wedding. The village sarpanch said they were eager to welcome the
newly wed couple home after their marriage in Delhi on November 8.

Talking to The Times of India over phone, Kuldeep Yadav, a Gujarat
cadre IAS officer, said the media created a hype over the marriage
which is disturbing, especially for the family of Neelam, a resident
of Patrawali village of Bhiwani. "Everything is going smoothly and we
are busy with preparations for the wedding ceremony, which will be
held in Delhi on November 8. The media was blowing the issue out of
proportion which hurt us both and Neelam's family in particular is
upset with this".

Asked about objections by some people from Neelam's village, he said
he would not like to comment on this at this moment and would be happy
to discuss the issue with media on November 9 (a day after the
marriage).

Sarpanch of Baldhan Kalan village, Nawal Kumar said that the entire
village was happy over the marriage. Kumar said that a pre-wedding
community feast has been organized by Kuldeep's family in the village
on November 7, adding that there was no objection from anybody
regarding the inter-caste status of the couple.

Obviously upset over media reports, Neelam's family is not willing to
talk to mediapersons on the issue. Neelam's brother Pawan Sharma said
they would invite family members and other villagers whom they
expected to attend the wedding ceremony.

Sunil Shastri, a villager who is close to Neelam's family, said that
he has been extended an invitation and would like to attend the
ceremony. He however said that a section of villagers might not be
happy over the inter-caste marriage but there was no opposition or
threat to the family.

Head of Brahmin Sabha, Mahender Sharma clarified that community elders
had objection over the decision of Neelam's family to marry her
outside the caste, but there was no opposition to the marriage. "There
has been no instance of an arranged marriage outside the caste though
youngsters had solemnized love marriages. Community elders expressed
their objection but there was no disapproval or threat to the
marriage", he said.

Kerala's CPI(M)-led Opposition LDF is presently on an agitation
against the alleged insult hurled out at its leader AK Balan, a Dalit,
by the Chief Whip of the Congress-led UDF Government with casteist
remarks but records show that the Marxists themselves have liberally
used such insulting remarks against Dalits when it suited them.

The Left stalled the proceedings in the Assembly the other day over
the insult Chief Whip PC George, known for making acerbic remarks in
speeches in the House and outside, showered on October 28 on Balan,
former minister and State CPI(M) secretariat member, with his
statement "I am not saying much as he belongs to Scheduled Caste."

Despite intense Leftist protests since October 28 inside the Assembly
and outside and severe criticisms from several leaders in the Congress
and other coalition constituents, George, vice-chairman of the Kerala
Congress (M), a constituent of the UDF, has stubbornly refused to
apologize for his derogatory references to Balan.

The Opposition has announced boycott of George in the Assembly and
outside. They will also not participate in TV talk shows if George
participates in such programmes. Balan himself has lodged complaints
with the Chief Minister and the DGP requesting action against George
under Prevention of Atrocities against SC Act, IPC and provisions of
the Police Act.

However, Dalit activists point out that the CPI(M)'s protests in the
name of Dalits and their rights are nothing but hypocritical drama
because the Marxists themselves have allegedly used derogatory remarks
against Dalit whenever that suited them. "Now, when one of them has
suffered a blow, they feel the pain," said Suresh Kumar, an Adivasi in
Aralam, Kannur.

Dalit rights workers recall the infamous reference to Congress's
former Dalit minister MA Kuttappan by former Marxist chief minister
late EK Nayanar, an upper caste Hindu. Nayanar had then referred to
Kuttappan as "That Harijan Kuttappan" but "Kerala has not heard an
apology coming from him," said Suresh.

The Nationalist People's Forum recalled how M Vijayakumar, a former
Marxist Minister and ex-Speaker, had insulted BR Ambedkar, the social
section he belonged to and a poor people's slum in Thiruvananthapuram
with his statement that the most suitable place for an Ambedkar statue
was the Chenkalchoola slum in the capital.

The forum took a direct dig at Balan himself saying that he had not
included even a single Dalit in his personal staff when he was power
minister in the 2006-11 LDF government. It also alleged that those who
wanted action against George for a "normal" reference as "SC man" had
been eager to deny quota benefits to Dalits.

Kochi-based sociologist BS Panicker points out that the Kerala
Marxists have consistently refused to listen to the grievances of
Dalits. "When about 10,000 Dalits agitated at Chengara in
Pathanamthitta for land to live and cultivate, the former LDF
government threatened them saying they would have to face police with
tooth and claw," he said.

"Then chief minister VS Achuthanandan had termed the leader of that
Dalit stir as a rubber thief. The LDF had described the agitating
Dalits as agents of the LTTE and Maoists," Panicker said. The Marxists
had even taken a theoretical position that identity politics was not
acceptable as part of a clever move to break the non-political unity
among Adivasis and Dalits unity, he added.

GARH SARNAI (PANIPAT): A dalit headwoman faced wrath of the entire
village when she tried to stop the marriage of a 13-year-old girl on
October 29. Headwoman Kanta Devi's son Jitender had written to SP
Pankaj Nain alleging that a daily wager, Rambali Sharma, was trying to
marry her minor daughter to Sanjeev, 28, of Kaithal.

District protection and child marriage prohibition officer Rajni Gupta
reached the house of Rambali Sharma and asked for the girl's birth
certificate, a student of Class VII. The parents were unable to
produce the birth certificate and the officer stopped the wedding.

Soon after, the villagers began demanding resignation of Kanta Devi
and said she had brought a bad name to the village. The matter
snowballed into a major controversy and a special panchayat was
called, where some villagers forced the sarpanch to sign the
resignation papers, sources said.

Meanwhile, Kanta Devi said she and her family were being targeted for
some vested interests. "I will not quit for doing something as per
law," she said.

The national Capital is all set to have a formal, structured group of
Dalit entrepreneurs who will hit the market from Saturday to sell
their goods and integrate themselves with capitalism as a form of
empowerment.

"Dalit Indian Chambers of Commerce and Industry (DICCI), which was based in
Pune till now, is launching its Delhi chapter on Saturday," Dalit
intellectual Chandrabhan Prasad told HT. Significantly, the launch
event is called Dalit Job Givers' Party.

"Dalits are not always seekers as they are shown to be. They are also
givers," said DICCI chairman Milind Kamble. "Entrepreneurship is an
even bigger form of empowerment than government job quotas."

The Dalit movement in India moved from an emphasis on "autonomy" from
upper castes — reflected in Ambedkar's demand for separate electorates
and call to embrace Buddhism - to a focus on empowerment through
access to government jobs via reservations. Mayawati's BSP was an
off-shoot of Kanshi Ram's Backward and Minority Communities Employees'
Federation, a body comprising Dalit government servants.

Badri Narayan, an expert on UP Dalit movement, says, "Now, empowerment
is being sought through market participation rather than government
jobs. But this is more a representation than a reality." However,
Kamble says Dalit entrepreneurship is a necessity, with the market
expanding faster.

Lucknow: We always have kept hawk�s eyes on the Mayawati's corrupt
administration and we are continuously drilling out malfunctioning of
some big guns running their ministerial-ship in the way they want to
run. To eradicate corruption from the country, senior IPS officer and
DIG Fire service D D Mishra, has started a 'muhim' against this
dishonest government and its corrupt ministers.

Unmindful of the consequences, a serving officer of the Indian Police
Service (IPS) on Friday blasted the Mayawati government, calling it
"thoroughly corrupt". DD Mishra is also a supporter of anti-corruption
crusader Anna Hazare.

Senior IPS officer D D Mishra has disclosed the corrupt working of BSP
government and its ministers. Mishra has told a news channel that the
Uttar Pradesh working has always been inclined towards the illicit
manner. He also claimed to have made some of his anti-government
observations on official files.

From last few days, government is lading pressure on him for illicit
buying and selling. Not only this, he has also been pressurised to
save some of the corrupt workers of his department. He has also
stamped his signatures in some of the files.

In a defiant mood, Misra appeared to be least bothered about the
consequences he may have to face on account of the All India Service
Conduct Rules which he was openly violating by attacking the
government.

He cleared his intentions of not getting into any politics rather he
said that he first had talks with his wife and only then he took this
serious step.

D D Mishra has always been a white collar officer of the Uttar Pradesh
state and after this disclosure of the Mayawati government�s corrupt
working; some believe that he may be punished to death.
