NEW DELHI: The issue of reservation for admission to AIIMS is creating
ripples once again. A section of senior faculty members has written to
the director, demanding the admission to BSc and MSc nursing courses
be stopped immediately because of alleged violation in the
distribution of seats among general, scheduled caste, scheduled tribe
and OBC candidates.

According to the letter, there is no reservation for the SC and ST
categories in MSc nursing this year, the counselling for which is to
be held on July 15. "The 18 seats have been divided into 14 unreserved
and four OBC seats. There is no reservation for SCs and STs," alleged
professor L R Murmu, one of the signatories to the letter. "Even last
year, no seat was reserved for SC/ST applicants."

According to the same letter, in BSc nursing, 60 seats have been
divided into 39 berths for the unreserved category, seven for SC, four
for ST and 10 for the OBC category. "The number of seats for SC/ST
ought to be nine and five, respectively. According to the prospectus
itself, 15% seats are to be reserved for SC and 7.5% for ST students,"
the faculty said.

Besides Murmu from the surgery department, the complainants include
Sunil Chumber, former sub-dean and professor of surgery, and
Shashikant, professor of social and preventive medicine. They have
demanded that the admission process for these courses be immediately
put on hold. "We demand that a time-bound inquiry be conducted to fix
the responsibility," reads the letter, also forwarded to the union
health minister and the National Commission for SC and ST among
others.

The official spokesperson of AIIMS could not be reached despite
several attempts. The registrar and the sub-dean said they were not
authorized to speak to the media.

A senior official, involved in the process of making the reservation
list, said on the condition of anonymity "We follow a roster-based
system. No rules have been flouted," he said.

In what comes as a pointer to the callousness of the UGC, the Rajiv
Gandhi National Fellowship (RGNF) selection list shows at least 18
candidates whose names appear twice from same institutes and subject
of research. With a specified number of fellowships, the erroneous
list denies
scholarship to at least 15 of the SCs and 3 of the STs deserving candidates.

Several more on the list of 2,000 for the SCs and 667 for the STs are
those who are already receiving the scholarship. Another mismanagement
in the UGC list put out in first week of May on its website is the
selection of the SC students in slots reserved for STs.

Awarded in the name of the late PM Rajiv Gandhi, the RGNF was
initiated by the UPA government in 2005-06 to support higher studies
for the socially disadvantaged sections.

Aspirants from JNU complained the list contains about 70 candidates
who were selected in 2009-10 and are receiving the fellowship. Anil
Kumar, who is pursuing MPhil from JNU is one such case. Kumar, who was
selected for the RGNF last year under SC category, confirmed to HT,
that his name appears on this list (slot 1706) even when he has not
applied this year. Interestingly, Kumar's name is not there on the
2009-10 list, when he actually applied. The revelations came as a
shock for those who are denied the scholarship, despite meeting the
criteria.

"It might be a goof-up or whatever, we want clarification from the UGC
on the authenticity of the results," Suman Bukke, an ST applicant from
Sri Venkateshwara University at Tirupati said.

Meanwhile, UGC officials and ministry of social justice and
empowerment said that they are not aware of the errors.

The BSP today termed as a "political drama" Congress general secretary
Rahul Gandhi's stay at dalit houses during his ongoing 'kisan
padyatra' and alleged that he did not have food prepared by them.

"Though Congress yuvraj had a night halt at the house of one person
belonging to 'kanjar' caste in Marodgarhi village of Aligarh yesterday
but he did not have food prepared there and it was ordered from
outside for him while for his staff it was arranged at the house of
the gram pradhan", a BSP spokesperson here said.

Terming such a behaviour indicative of Congress party's casteist
mentality, the spokesman said that these stays at the houses of dalits
and backwards were nothing but "political drama".

"But in UP it has been instigating farmers or organising panchayats
when the state's acquisition policy is far better than that of other
states, it is this not indicative of anti-dalit mentality", he asked.

Uttar Pradesh chief minister Mayawati on Friday trained her guns at
Congress general secretary Rahul Gandhi for allegedly refusing to have
a meal in a Dalit's home, where he spent Thursday night, during the
course of his four-day padyatra in the state's western parts. Terming
the padyatra as a "gimmick" and "melodrama", the statement on behalf
of Mayawati said: "Rahul Gandhi spent last night in the home of Uday
Vir, a dalit belonging to the kanjar sub-caste in Marodgarhi village;
but he preferred to get his food from outside and even his personal
staff and security personnel chose to eat at the local village head's
home."

"This clearly depicts that Rahul is basically anti-Dalit and has
simply been staging a drama by sleeping in the homes of Dalits with
whom he avoids eating a meal," the statement said.

Hitting out at Gandhi scion for raising the pitch about farmers'
problems in parts of Uttar Pradesh, the statement said: "Why doesn't
he go to the Congress-ruled states where farmers were getting a raw
deal?"

Reacting to Gandhi's repeated attacks on the state's law and order
situation, reflected in the spate of rapes over the recent past, the
statement said if he was really concerned about insecurity of women,
then "why did he not care to visit the poor women who have been raped
in Congress-ruled Delhi or Haryana?"

Three men and a woman have been booked for the gangrape of a
15-year-old Dalit girl in Haryana's Sirsa district, police said on
Saturday. According to police, the girl was gangraped at Suchan
village in May but her parents registered a complaint only on Friday
night. The
accused were identified as Sanjay, Darshana and her two sons Sonu and Naresh.

"According to the complaint, Darshana had called the victim to
Sanjay's house on May 30. Then she left her alone in the house with
three men. After raping her, the accused threatened her not to report
the matter," said a police officer.

CHENNAI: Dalit residents of Kathirvedu village in Puzhal have alleged
that their houses were demolished and their lands grabbed by a DMK
functionary in 2007. Living in rented houses since then, the residents
have now pinned their hopes on Chief Minister J Jayalalithaa.
Residents of Indira Nagar and JJ Nagar claimed that about 73 Dalit
families had been living on 3.6 acres of 'poromboke' land for over 16
years.� In 2005, the residents had petitioned the Tiruvallur Collector
to provide them basic amenities, including drinking water supply and
roads, and the same were provided in 2006. Later, the residents also
requested 'pattas' and electricity supply to their area.� In the
meantime, a DMK functionary, who claimed himself to be the personal
assistant of a DMK leader who held an important position in the
previous government, reportedly threatened them to vacate the place as
the leader wanted the land. He had also told the residents that they
would be given another land and Rs 50,000 for each family for
constructing a house. After giving them two days time to vacate, the
DMK man demolished their houses with the help of goons, the residents
alleged, adding that a few of them were given only Rs 20,000, while
the rest were chased away. "He is now using that land to park 30
lorries and is taking rent for it. He has also constructed a compound
wall around the land," said E Pazhaniammal, one of the residents and
president of Senthamarai Women Self-Help Group, Kathirvedu.

The residents had since then been living in rented houses. "We now
hope the CM will help us get back the land and take action against the
DMK man," she added.

JAIPUR: In a first ever move of its kind, the state home department
recently took up 31 cases of atrocities against Scheduled Castes,
offering relief to the victims. Most of the cases were registered
under the Protection of Civil Rights Act, 1955, and the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The move followed a study by the Society for Participatory Research in
Asia (PRIA) and the Jaipur-based Centre for Dalit Rights (CDR) over
two months on the plight of state Dalits. The study also looked into
the role of statutory bodies such as the State Human Rights
Commission, Commission for Scheduled Castes, Women's Commission and
the State Assembly's Committee on Welfare of SCs in providing relief
in these cases.

The study's conclusion that the commissions have failed to provide
constitutional safeguards or redress grievances of Dalits made the
state government sit up and take notice. It was then that the home
department approached the CDR and requested it to provide details of
31 specific cases submitted earlier to different commissions, forums
and the government departments concerned. No Dalit in these cases has
got relief. tnn

SAMBALPUR: Police arrested a lawyer from Jharsuguda on Sunday in
connection with the mysterious death of a Dalit girl, who allegedly
died after consuming poison on Saturday night.

Police suspect the death of the girl to be linked with a blue film
racket in the region, refraining from divulging further details on the
matter at this juncture, however. "We are still at the preliminarily
stage of the investigations in this case. But we have registered a
case and arrested one person in connection with the death of the
girl," said Jharsuguda police station inspector Kailash Acharya.

The girl, identified as Padmini (18) of Remunda village under
Lakhanpur police station of Jharsuguda district, was said to be a
regular visitor to the house of one Uttara Gardia of Sarbahal area of
Jharsuguda town, who worked as a lawyer, police said. On Saturday
night, Uttara and two of his friends admitted the girl to a local
hospital in a critical condition. They told the hospital staff she had
consumed poison in an attempt to commit suicide. Uttara and his
friends left the hospital soon after admitting the girl, who died a
few hours later while undergoing treatment in the hospital.

"We have sent the body for autopsy and are waiting for the report to
conduct further investigation," inspector Acharya said.

The girl was forced to attempt suicide when she found herself in a
blue film being circulated in Jharsuguda town, shot in a hotel room.
The couple who appeared in the film resembled the deceased and Uttara,
sources said.

Dalit girls electrocuted

Jaunpur (UP), July 11 (PTI) Two Dalit girls were today electrocuted
after they came into contact with a live electricity wire in Jalalpur
area, police said here.

Kajal (9) and Shikha (10) were electrocuted when they came into
contact with the snapped live wire this morning when they had gone out
in connection with some work in Pradhapur village, they said.

Police said that the bodies have been sent for post mortem.

Mangalore, July 11: Karnataka State Legislature Scheduled Castes and
Scheduled Tribes Committee under the chairmanship of Mudigere MLA M P
Kumaraswamy on Monday met Union Law Minister M Veerappa Moily in New
Delhi.

Mangalore MLA U T Khader, who was also part of the delegation, said
that they appealed the minister to make provision for the reservation
for SC/ST in the appointment of judges in Supreme Court and High
Courts.

The committee also brought to minsters notice that the welfare schemes
are not fully implemented because of the lack of law to punish the
officer who failed implement the schemes.


The delegation also urged the minster to make an effective law to
punish the officers who do not take interest in implementing the
welfare schemes.

They also appreciated the Union Minster's concern towards the SC/ST
and other backward communities.

Gowda, Chikkamadu, Shankarappa, Srinivas Gubbi, Sajjan kumar, Deputy
Secretary of Karnataka Vidhana Sabha Mr Chinnaswami and Mohan Kumar
were also present on the occasion.

The Law Minister assured the delegation that he would go through the
request made by Committee and do the needful within the frame of
constitution.

HYDERABAD: A GO directing the prosecution lawyers to appeal in the
High Court against the Guntur trial court's verdit in the massacre of
eight Dalits in Tsundur in Guntur district in 1991, has remained
unheeded for three-and-half years.

In normal circumstances, an appeal has to be made in a higher court
within 90 days of the delivery of judgement by a lower court. But for
reasons unknown, the work in this case remained unattended to though
GO 13 was issued on Jan 30, 2008.

The Guntur trial court, in its judgement on July 31, 2007, acquitted
123 of the 219 accused. B Chandrasekhar, special public prosecutor of
the trial court, then suggested to the then High Court public
prosecutor C Nageswara Rao to prefer an appeal against 60 of the
acquitted and� convicted because they had a lighter sentence. Later,
in January, the GO was issued to this effect but not implemented.

Now Chandrasekhar is the special public prosecutor in the High Court
and is getting ready to implement the GO which was issued at his
suggestion. "On behalf of the government we will be filing an appeal
in about 10 days' time," he said.

Of the 219 accused, 33 had died by then and seven were declared
absconding. Of the remaining 179 accused persons, 21 were awarded life
imprisonment and 35 were let off with one-year sentence. The remaining
123 were acquitted but the prosecution had felt that there was
evidence against 60 of them and the trial court's verdict should be
challenged in the High Court. The prosecution also felt that appeal
could be preferred against 35 who were let off with one-year sentence
because they faced murder charges and also against the 21 who were
awarded lifer since the sentence was given in respect of one murder
and they were involved in the murder of seven other Dalits as well.

On August 6,1991 eight Dalits were massacred in Tsundur in Guntur
district, shocking the nation. It was a crime perpetrated allegedly by
socially-dominant Reddy and Telaga caste persons against the SCs.

NAGPUR: The callous attitude shown by the Nagpur Improvement Trust
(NIT) and Nagpur district collector has ensured that the state
government's Rs 11.62 crore grant is not used for the upgradation of
Dalit localities in the city. These localities still remain in poor
shape.

More shocking is the fact that Nagpur district collector issued
utilization certificates (UCs) without verifying whether NIT had
utilized full amount sanctioned for the past financial year. The
district collector usually issues a UC confirming proper use of funds
meant for a particular scheme.

As per information obtained by Ramdaspeth resident Anil Wadpalliwar
under RTI Act, NIT has spent Rs 39.89 crore out of the Rs 51.51 crore
grant sanctioned by government between 2004-05 and 2009-10.

Comptroller and Auditor General (CAG) has lashed out at NIT for its
callous attitude. The agency pointed out NIT had diverted a part of
these grants for other works including construction of a swimming pool
in Vaishali Nagar and a sports complex in Ahuja Nagar.

State government sanctions funds under Dalit Vasti Sudhar Yojana
(DVSY) on 100% grant basis to local bodies for improving the civic
amenities of localities where more than 50% population is of SC
community. The works include roads, gutters, water pipelines, public
latrines, etc.

The funds are released to the district collector. The planning
department of district collectorate approves the DVSY works and then
releases the grants to the concerned civic body. After completion of
the work, the collector has to issue utilization certificates (UCs)
stating that the grant has been properly spent by the civic agency.

When CAG scrutinized the records, it found out that the Nagpur
collectorate had released the grants to NIT without any detailed list
of works and the areas where they were to be carried out. NIT planned
the works on its own without proper planning, which led to around
22.5% amount remaining unspent.

When this came to the notice of state government it did not sanction
any DVSY funds in 2009-10 to NIT. Thankfully, NIT spent Rs 16.30 crore
of the unspent amount pertaining to 2004-05 to 2008-09 period in DVSY
works in 2009-10.

CAG further pointed out that NIT had not prepared any year wise plan
for DVSY but sanctioned works as demanded by public representatives of
Dalit localities. This led to large chunk of funds remaining unspent.
CAG blasted the collector office for not checking this lapse.
