Mirchpur Dalit killing recounted in Delhi court

New Delhi, Jun 23 (PTI) The killing of Dalits in Mirchpur in Haryana
was today recounted in a court here as the son of a 70-year-old man,
who was burnt alive along with his phyiscally challenged daughter by
dominant Jat community people, recalled the chain of events in his
deposition.
Making his deposition before Additional Sessions Judge Kamini Lau,
25-year-old Amar Lal, son of slain elderly dalit Tara Chand, said that
on the fateful day of April 21, 2010, a 400-strong mob of Jats had
descended on the village, armed with stones, in rickshaws and carts
and attacked the villagers who were barely out of their beds.
Lal said he saw his co-villagers taking shelters on roof- tops of
their houses and retaliating to the massive stone- pelting by the
crowd. He saw Narnaund police station in-charge Vinod Kumar Kajal, who
too is an accused in the case, asking the villagers to gather at the
chaupal, where, he said, he would sort out the issue after a meeting
with Jats.
"The station house officer also assured us that he would also bring
the Jat people to the chaupal and would try to sort out the things,"
Lal said, adding noting came out of the mneeting as hardly any of the
influential jat community members attended it. .

New Delhi: Over 300 people have been arrested in Tamil Nadu's
Thondamutur town for caste discrimination. All those arrested are
members of a higher caste Gounder community and were trying to stop a
bus from entering a low caste village, that houses about 500 Dalit
families.

One of the villagers from the minority community said, "When we travel
in buses we are forced to get up from our seats and the upper
community orders us to get up and says that they (Gounder community)
should be the only ones who can sit."

"This kind of discrimination existed only at the school level, but
this has begun to spread in villages and buses as well," the villager
added.

They have been demanding for buses to become operational in their
village, but the Gounder community did not allow it.

Many school children were also taken into custody. Hundreds of
policemen have been deployed to avoid any communal clash between the
two communities.

NCSC orders second post mortem of Dalit rape victim

Gonda (UP), Jun 24 (PTI) The National Commission for Schedule Caste
and Schedule Tribe has ordered a second post mortem of the 16-year-old
girl, who was allegedly raped and killed in Karnalganj area.

"The family members of the victim have alleged that the girl was raped
before being killed, but it has not been confirmed in the post mortem
report and pathological examination. But there could be no other
motive behind the incident," Chairman of the Commission P L Punia
said.

He alleged that under the pressure of administration and police,
doctors were preparing false post mortem reports.

Punia said that Nighasan case in Lakhimpur district, where second post
mortem of a 14-year-old girl revealed she was killed, was a glaring
example.

"The administration has been directed to conduct second autopsy of the
girl so that correct facts come to light," he said.

A 16-year-old Dalit girl was raped and killed allegedly by three
persons in Karnilganj area.

Body of the victim, who was missing since June 17, was recovered from
a field in Kaitholi village on June 19 evening.

Superintendent of Police Durga Charan Mishra, however, said that no
directive has been received from the Commission so far.

Bhubaneswar, Jun 24 (PTI) Breaking the age-old ban on the entry of
dalits into a Hindu temple in Puri district, Chairman of the National
Commission for Schedule Castes P L Punia today entered the premises of
Kali Temple at Ranapada village under Brahmagiri police station.Punia,
along with senior officials of the commission, went to Ranapada
village on the bank of Chilika lake after getting information on the
prevalence of the practice of untouchability in Puri district."I first
informed the gathering that I am a dalit and then entered into the
Kali temple," he said.Though no one opposed Punia's entry, the main
temple was closed before his arrival. "I was shocked to find that the
temple closed before my arrival. Generally, they perform 'aarti' and
other rituals during evening. But they deliberately closed it," Punia
told PTI over phone.Describing it as a "serious" matter, Punia said
the temple authorities had also removed a sign board announcing that
dalits were allowed only to a particular spot from where they could
have 'darshan' of the Goddess.During his interaction with upper caste
people at the village and also the priest of the temple, Punia was
informed that as it was against the tradition, the dalits were not
allowed entry."Our fore-fathers did not allow dalits to step inside
the temple. We will like to obey the tradition," a villager told
Punia.Stating that there was gross discrimination against dalits in
the village, he said he would take up the matter at the national level
as the community had been put to socio-economic boycott by upper caste

After arresting three men in the fake admission racket, Delhi police
will now turn the heat on SC/ST cell of Delhi University and the
parents of those students who had submitted fake caste certificates to
get admission. Police suspect the involvement of an insider, likely to
be from the SC/ST cell, as they are the one who check the authenticity
of caste certificates.

Sources in the crime branch said the staff of SC cell will be
questioned on Monday. Parents and students will also be called for
questioning, as they are equally responsible.

SC/ST cell is the common body that takes care of the admission of
students belonging to this category and issues cut-offs that are
different from the regular cut-offs.

"The students who had submitted fake caste certificates had given
wrong addresses. If the address in caste certificate and one on other
identity proof are different, then the person clearing the form should
cross check its authenticity. If he is not doing so, then either he is
not doing his job properly or he is also involved in the racket," said
a senior police officer.

Police said caste certificates were submitted at the cell and they
forwarded it to colleges.

Out of 12 students who were found to have taken admission on fake
caste certificates, 11 showed that they belonged to SC category while
one showed the certificate of OBC - all these students are from
general category.

"The parents paid for these fake certificates, so we are going to
question them and then take legal action. In a case of cheating the
liability falls on the person who is getting benefited; in these cases
it is the students. They will also be questioned," the officer added.

Sources said all the 12 students are living in south Delhi and are
from prominent schools.

Slammed by the National Commission for Scheduled Castes (NCSC) over a
tradition baning entry of Dalits into a Hindu temple in Puri district,
Orissa government today said it would look into the matter and try to
resolve it.

"We will look into it and see how the matter can be resolved," chief
minister Naveen Patnaik told reporters, a day after NCSC chairman L
Punia visited the temple premises at Ranapada village under Brahmagiri
area and attacked the state government for prevalence of the age-old
tradition.

Punia along with senior NCSC officials, rushed to the village on the
bank of Chilika lake yesterday after getting information on prevalence
of untouchability practice there.

Voicing serious concern, Punia said the main temple of Goddess Kali
had been closed before his arrival there. Temple authorities had also
removed a sign board which stated that Dalits were allowed only to a
particular place from where they could have 'darshan' of the Goddess.

Terming the age-old practice as a discrimination against Dalits, the
NCSC chairman said he would take up the matter at the national level
as the community had been put to socio-economic boycott by upper caste
people.

The commission will also seek a report from the state government
asking it to explain as to why law had not been enforced to protect
the interest of Dalits, he said adding it would take up the matter
with the state police chief and other concerned authorities.

"Media reports on Dalit entry into the temple is correct and I
verified it. While upper caste people are allowed to go close to the
goddess, the Dalits are asked to keep themselves far away from the
idol. This is a clear case of violation," he said.

The NCSC also pointed out that three Dalit girls were punished for
entering into the temple in September 2010. "We were told by the state
government that everything had been set right. One person was arrested
and people had been living peacefully," said director of NCSC, Kolkata
SK Naskar, who accompanied the chairman.

Though nine months have elapsed since the girls were punished for
entering into the temple, the socio-economic boycott is continuing.
The Dalits are mostly engaged in share cropping and eke out living by
working in others' field. However, after the September 2010 incident,
they are not given work and subjected to miseries, Punia said.

During his interaction with upper caste people at the village and also
the priest of the temple, Punia was informed that Dalits were denied
entry as it was against the tradition.

The villagers said their fore-fathers did not allow Dalits to step
inside the temple and they would like to follow the tradition,
according to Punia.

Punia also met Chandana Bhoi, one of the young girls who visited the
goddess in September 2010. She narrated her experience and sought
protection from the commission in the face of social discrimination,
he said.

Ranapada village has at least 80 Dalit families who were facing
socio-economic boycott for the last nine months, he said adding NCSC
would seek a report from the state government on the matter.

Ahmedabad : A fiat from the state government's Admission Committee for
Professional Courses (ACPC) to the Nirma University (NU), Pandit
Deendayal Petroleum University (PDPU) and Dhirubhai Ambani Institute
of Information and Communication Technology (DAIICT) regarding
reservation for SC, ST and OBC categories in admissions has landed
these prestigious private institutes in a dilemma.

While all the professional and technical institutes in the state were
following the admission policy set by the Union HRD ministry granting
reservation to SC, ST and OBC categories, the three private
universities were not.

ACPC member-secretary M N Patel said the directive has warned these
three institutes that the ACPC would not approve the admission list
even if there was the slightest violation in this regard.

Patel said while NU and PDPU had halted the admission process and were
deliberating how to implement the reservation policy in admissions,
DAIICT had already completed the admissions as they had been doing for
the last 10 years. Patel said the ACPC would not ratify the merit list
of DAIICT under any circumstances. "They will have to revise it as per
HRD ministry's policies," he said, adding even institutes like IIM-A
implemented the reservation policy.

NU vice-chancellor R R Vasani confirmed the receipt of ACPC's letter.
"We are discussing with the government how to go about it."

However, DAIICT director S C Sahasrabuddhe said: "We have already
completed admissions in the same way as we had been doing for ther
last 10 years." Asked whether the reservation policy of HRD ministry
was followed, he said, "I don't know about and I can't comment on it."

PDPU director general Paritosh K Banik said the university authorities
were discussing the matter.

Dalits demand law to establish rights

Dalit community at a national convention yesterday demanded budgetary
allocation and formulation of a law to establish their rights.

Representatives of the community placed a 10-point demand at the
convention jointly organised by Bangladesh Dalit Parishad and
Paritran, a non-government organisation, at Ramesh Chandra auditorium
of Chhayanaut Bhaban in the city.

They also demanded the government open a special department in
National Human Rights Commission and a national Dalit commission to
stop discrimination against around 75 lakh Dalits in Bangladesh.

They urged all political parties to ensure representatives of the
community in their committees at national and local level and special
quota for students of the community in government schools and
colleges.

"We are treated as servants of the state for our services, but the
government is always depriving us of all basic rights," said Ashok
Kumar Das, the parishad general secretary.

When victimised, Dalits do not get legal assistance due to lack of
cooperation from law enforcement agencies, said Bikash Kumar Das,
Paritran project coordinator.

Denmark Ambassador to Bangladesh Svend Olling and Paritran executive
director Milon Das also spoke.

Around 200 Dalits attended the convention.

High cut-offs and the race to get into a 'branded' college made a
cheat out of a girl who scored 94.25% in her Class 12 board
examinations. Despite getting such a high score, the girl presented a
fake OBC certificate at Shri Ram College for Commerce. Her choice of
subject was B.Com (honours) for which she would not get admission
under the general category as the cut-off was 96%.

Eliciting a strong reaction from colleges and university authorities,
the incident has stirred up a debate.

"This clearly shows lack of parental guidance. Parents want their
children to be honest to them but forget this very rule when it
applies to themselves," said Deepak Pental, former vice chancellor of
Delhi University.

"The rot is deep seated. Students want to flock to these colleges as
big corporates hire students from a select few colleges only,
perpetuating the myth of 'top colleges'. I don't believe that SRCC
teaches commerce better than other colleges but the companies think
so," Pental added.

On Saturday Delhi Police came across 11 other cases of admission using
forged scheduled caste certificates. But some students HT spoke to
feel the pressure to get admission in the so-called good colleges gets
to them.

"What are we supposed to do? Despite getting high scores, admission in
better colleges of the university is not assured. It a sad affair,"
said a student, wishing to remain anonymous.

It is this pressure that promoted such scams, feels VK Srivastava,
principal of Hindu College.

"Sky high cut-offs, coupled with the perceived reputation of colleges,
is forcing people to adopt such means," he said.

Students belonging to SC/ST category are not admitted by the colleges directly.

They have to register themselves with the SC/ST cell, which in turn
allots colleges on the basis of merit. OBC candidates are, however,
admitted by the colleges directly.

"After students furnish the SC/ST certificates, we create a data-base
and do a random sampling. If something fishy appears we send the
certificate for verification to the resident commissioner of the state
from which the certificate originates," said Gulshan Sawhney, deputy
dean, Students' Welfare, DU.

If the certificate is found to be forged, the student's admission is
cancelled with immediate effect.

"The most reliable way to find out if a student is lying is through
tip-offs. Students who were not able to make it to the list will
complain about students who got through using illegal means. We take
their complaints seriously and send the certificates for examination,"
Sawhney added.

Pushkar village tense after residents threaten Dalit bride kin

AJMER: Tension prevailed at Dungaria village in Pushkar on Monday when
the police had to escort a Dalit groom after the bride's family was
allegedly threatened by the local residents.

This is the third reported incident in the district in a year where
the police had to intervene and provide security to the Dalit marriage
processions.

Police said a complaint was made by Kannaya Lal Raiger – a Dalit – of
Dungaria village near Pushkar that a group of villagers threatened
him. They had warned him and his family of dire consequences if the
groom came on horseback. "My daughter's marriage was fixed with Naveen
Kumar of Renn village in Naguar.

Sources said even a panchayat meeting was called on this issue but the
group was adamant on its demand. "They said for the last 400 years no
Dalit family has taken out a marriage procession in the village.
Dalits celebrated their weddings outside the village," said a panch.

"This has been practised for centuries by our ancestors and the
influential people of the village insist that we do so even now," said
a youth.

"Land issue remains pertinent to emancipation of Dalits"

Despite the existence two special laws to protect the Dalits —
Scheduled Caste/Scheduled Tribes (Prevention of Atrocities) Act, 1989
and Protection of Civil Rights, 1955 — Dalits seem to be victims of
various forms atrocities, said S.Viswanathan, Readers Editor, The
Hindu.

Addressing a State-level consultation on land and resource policy for
Dalits, organised by Evidence, a Madurai-based human rights
organisation, here on Saturday, he said that the Land Reforms Act and
Land Ceiling Act which were brought to remove the unequal land
relations had not been achieved even after 60 years. The Tamil Nadu
Land Reforms (Fixation of Ceiling on Land) Act, 1961, was aimed to
reduce the concentration of land in the hands of a few, to end
disparities among landholders and ensure a just and equitable
redistribution of land.

The major reasons why the Land Ceiling Act failed to acquire more land
for distribution was the advance public announcement about the
proposed Act, which gave enough time for many big landlords to
circumvent the law through fictitious transfers of land. There was no
will on the part of the State to implement the Act. Trusts were formed
by zamindars and lands were diverted by those means.

In the recent past, it was the Mahatma Gandhi National Rural
Employment Guarantee Scheme that had given a great economic relief for
the Dalits and other deprived sections of society in the rural areas.

Citing economist Sukhdeo Thorat's arguments that the government should
bring in Equal Employment Act, he also talked about the need to create
opportunities for Dalits in private sector and the media. Land
question remained pertinent to the emancipation and empowerment of
Dalits.

An economic survey done by William Goudie and the Wesleyan Christian
Missionaries during the late 1800s in Madras Presidency found that
Dalits were living in the most inhuman of conditions with high levels
of oppression and submitted a memorandum to the British government to
allot lands to the Dalits to improve their socio-economic condition.

The speakers at the consultation appreciated The Hindu and said that
it played a prominent role by espousing the cause of social justice
which continues till date. As early as the 1800s, The Hindu had played
a prominent role in representing the Dalit cause. It was during 1891,
civil servant J. H. A. Tremenheere, the then Collector of Chingelpet,
argued that the government's emancipatory policies had not led to the
social and economic elevation of the Depressed Classes (Dalits).

In this regard, he seemed to have been influenced by a report that had
been published in The Hindu on 7 August 1891. There was a discussion
in the Letters to the Editor column on the condition of Dalits. The
British government approved Tremenheere's demand and enacted a law in
British Parliament to distribute land to them to improve their
socio-economic conditions. The Government of Madras passed the
Government Orders 1010 and 1010A dated 30 September, 1892 to specify
that lands would be assigned to the depressed classes. Once the G.O.
was published, the panchami lands were reserved and a few were
assigned.

It was estimated that a total of 3.20 lakh acres had been gifted to
the Dalits by the British Government in all the districts of Tamil
Nadu. Land rights and education were the two important things that the
late Tremenheere emphasised but both still seem to be at large, said,

K. Samuel Raj, general Secretary, Tamil Nadu Untouchability
Eradication Front (TNUEF), said that one has to remember Dr.Ambedkar's
words here: Is it because that he is a Dalit, he has no lands at his
possession or since he has no lands at his possession, he is a Dalit?
Ambedkar was an intellectual who believed that there was a thin line
which separated caste and class.

Speaking on the current scenario in the Chennai metropolis where the
Dalit population seemed to be declining, it was later found that they
were pushed to the margins of the city because of the urbanisation
process. TNUEF was engaged in uniting the entire splinter Dalit
organisations to fight on this issue.

LUCKNOW: Taking a serious note of the mysterious circumstances
surrounding the death of former deputy CMO Dr Yogendra Singh Sachan,
the national SC/ST commission has served a notice on Uttar Pradesh
government and demanded an explanation into its reservation against
recommending a CBI inquiry.

Chairperson of the commission PL Punia has directed the state
government to furnish its reply by July 4. Prima facie Dr Sachan's
case appears to be that of a murder and not a suicide as being
reported by the official agencies. The entire story as touted by the
government seems too fishy and there are more questions than answers
surrounding the incident. Therefore the matter needs to be probe by
the prime investigating agency and only a CBI inquiry will be able to
clear the air, Punia told media persons on Saturday.

Punia said, "The state government has been served notice under article
38 sub clause (10) of the Indian Constitution, which vests the SC/ST
commission with power to intervene and address any grievance of a
member of a backward community or the Anglo Indian community."

This task, Punia stressed has not been assigned to the National
Backwards Commission, "but is the prerogative of the SC/ST commission
as per the provisions of the constitution". Since Dr Sachan was a
Kurmi, a backward caste, the commission, he pointed out was well
within its right to take up the matter. The notice was dispatched to
the chief secretary of UP government Anup Mishra.

The commission was recently in news for taking suo moto cognizance of
the Nighasan rape and murder case, where a 14-year-old girl was found
hanging from a tree within the police station premises. Punia had
summoned the SSP and DM Lakhimpur Khiri to make personal appearance
before the commission and explain.

Significantly the pro-active mode of the chairperson is leading to
much consternation among the ruling party, as animosity between the
BSP supremo and his one time aide is well known here. The war of words
between the party top brasses and Punia began soon after he took over
the charge and declared during his first press conference that
atrocities against the dalits were on the rise and that the UP police
was trying to push most of the cases under the carpet. While, he
raised the pitch, the Maya government retaliated with a decision to
make the state guest status to visiting dignitaries, discretionary,
and the tussle continues.

Puri: A day after NDTV reported how a temple in Orissa's Puri
district doesn't allow Dalits to enter its premises, and had
victimised three Dalit girls, who had had defied the ban, the chairman
of the National Commission for Scheduled Castes visited the temple for
an on the spot assessment.

Mr Punia faced no resistance while entering the temple, even after he
declared that he was a Dalit.

The board displayed at the temple banning the entry of Dalits had been
removed. But Mr Punia said he will ask the Orissa government to take
action against the temple management.

"Our Constitution in article 17 says that untouchability in any form
is prohibited, and there is a provision in protection of Civil Rights
Act section 3A B, which categorically says that in public temples if
there is a discrimination and the members of the Schedules Caste are
discriminated on the basis of their caste then it is an offense...so
we must make the law more stringent and in addition to this we must
also spread awareness among the people," said Mr Punia.

MADURAI: A 48-year-old Dalit was pushed down from his motorcycle and
run over when he refused to allow a caste Hindu, who had arrived after
him, to fill fuel at a petrol bunk.

According to Evidence, a Madurai-based NGO, Patchirajan (48) of
Keelanalumoolaikinaru village near Thiruchendur had gone to a petrol
bunk on his motorcycle along with his friend to fill fuel. Soon after,
a caste Hindu of a neighbouring village, Muthu, arrived in a travels'
van and asked Patchirajan to make way for him. When Patchirajan
refused to do so, Muthu abused him with references to his caste.

When the Dalit pointed out that that he had arrived before him and
should, therefore, be served first, an irate Muthu allegedly hit him
with an iron rod and rammed his vehicle against the motorcycle. When
Patchirajan fell down, Muthu reportedly ran his vehicle over him,
injuring him seriously. He was rushed to the Thiruchendur hospital,
but succumbed to his injuries later.

The Thiruchendur police, who registered a case, have arrested Muthu
and charged him with wilful murder and under the provisions of the
Prevention of Atrocities Act. He was produced in court and remanded in
custody.

Patchirajan is survived by a wife, son Dinesh Babu (25) and daughter
Sujithamalar (22).

A Kadir, director of Evidence, said a fact-finding team had gone to
Thiruchendur after getting wind of the attack. He said it was shocking
that such an attack wasd made in a public place like a petrol bunk.

This, he charged, showed the scant respect that some caste Hindus had
for the laws of the country like the Protection of Civil Rights Act
and Prevention of Atrocities Act.

He urged law enforcement authorities not to treat Patchirajan's death
as just another murder case but instead consider it one with with
communal overtones.� "Ninety-nine per cent of caste-related murders
are treated as just ordinary murders, which gives high caste persons
impunity to kill," he explained.

Kadir demanded that the Patchirajan's next of kin be given `5 lakh as
compensation and the amount recovered from the accused to serve as a
lesson to other like-minded persons.
