Banda rape victim to be in jail till January 17

Lucknow: The 17-year-old Dalit girl, who has been allegedly raped by
Bhaujan Samaj Party (BSP) MLA Purushottam Naresh Dwivedi, on Friday
repeated her testimony in a Banda court in Uttar Pradesh claiming that
the legislator had raped her.
The court will hear her bail petition on January 17. The rape victim
has been in the jail on charges of theft. The MLA has accused her of
stealing cash and a mobile phone from his house.
Her lawyer Aparna Bhat said that the child cannot get justice in Uttar
Pradesh and the case should be transferred out of the state.

The Uttar Pradesh government has come under fire for acting three
weeks too late.
"I am sorry to say that the state government. Right from the beginning
it is trying to hush up the whole matter and trying to save the BSP
MLA. When there was all-round pressure from all sides on the state
government it was left with no option but to take action against the
MLA. He is still the BSP MLA and has not been expelled from the BSP
and they are yet to take action against those police officers who
falsely implicated the victim," said National Commission for Schedule
Caste Chairperson PL Punia.
"It is outrageous that after all this that young minor rape victim who
needs to be protected and cared for by state and society is
languishing behind bars. The Mayawati government has to answer," said
Communist Party of India (Marxist) Politburo member Brinda Karat.
The 48-year-old Dwivedi, who represents Naraini seat in Uttar Pradesh
Assembly was arrested on Thursday after he had been absconding for
many days. He has been sent to 14 days of judicial custody by the
Banda chief judicial magistrate.
The girl has alleged that the MLA raped her on December 10-11, 2010,
at the his residence. She escaped from the MLA's house on December 12
when the he allegedly attempted rape for the third time. She was the
same day on theft charges.
The MLA's two aides, Rajendra Shukla and Surendra Neta, have been
arrested. But third accused, Ravan Garg, is still absconding.
