Dalits in Orissa demand minister''s dismissal, arrest

Bhubaneswar, Sep 30 (PTI) Orissa Dalit Mahasabha today demanded
immediate dismissal and arrest of a senior minister accused of passing
derogatory remarks against some people belonging to the scheduled
caste community.
Five dalit organisations held a rally here under the banner of Orissa
Dalit Mahasabha where leaders cutting across partylines demanded
Damodar Rout''s resignation and arrest.
Rout, who is also vice-president of the ruling BJD, had at a public
meeting in Kujang of Jagatsinghpur district on August 18, allegedly
made derogatory remarks against the local MLA, MP and an officer
taking the name of their caste.
A complaint was also registered against Rout at Kujang police station
on charge of violating rules under the Scheduled Caste and Scheduled
Tribes (Prevention of Attrocities) Act, 1989.

VIJAYAWADA: After many twists and turns, the sensational Ayesha Meera
rape-cum-murder case finally culminated in a lifer for main accused
Pidatala Satyam Babu (24) here on Wednesday sparking off protests from
various quarters.


Satyam Babu of Anasagaram village in Krishna district was held guilty
on two counts of murder and rape. He was handed life imprisonment for
murdering Ayesha Meera, an under-graduate, under Section 302 of the
IPC and asked to pay Rs 1,000 or undergo six more months in jail if he
fails to pay up.

The court sentenced him to 10 years imprisonment and imposed a fine of
Rs 1,000/six more months in jail under Section 376 of the IPC for
raping the girl. Both the sentences will run concurrently.

Satyam Babu pleaded with the Mahila Sessions Court Judge P Sree Sudha
to hang him if he was found guilty but prayed her to consider the
plight of his mother and sister before delivering the verdict.

His mother and sister are dependent upon him for their livelihood.

Additional Public Prosecutor G Uma, however, would have none of it and
argued strongly in favour of capital punishment for the accused. She
cited Supreme Court judgments to buttress her arguments.

Senior advocate Karnati Rammohana Rao, Bojja Tarakam, P Srinivas, ASS
Ramprasad, B Sambasiva Rao, VNV Rajyalakshmi, Pilla Ravi and K
Sudhakar Raju defended the accused in the 2 1/2 years old case. The
defence lawyers sought time to prepare their final arguments prompting
the judge to adjourn the proceedings till noon. The 103-page judgment
was delivered after the court reassembled.

Tension gripped the court premises soon after with several Dalit
organisations locking the main gate in protest against the "injustice"
meted out to Satyam Babu.

"The government has punished an innocent young man to shield the real
culprits," the protestors alleged.

Dalit Sthree Sakthi state convener and High Court advocate G Jhansi
said a Dalit had been victimised and punished for a crime committed by
influential people.

She wondered why the government was so desperate to help the real murderer.

The protestors raised slogans and said people would lose confidence in
the judiciary if an innocent man like Satyam Babu was punished. They
blamed the police for wrongly implicating him in the case.

Elite Colleges, or Colleges for the Elite?

TODAY'S populist moment, with a growing anger directed at the elites
who manipulate the system to their advantage, is an opportune time to
examine higher education's biggest affirmative action program — for
the children of alumni.

At our top universities, so-called legacy preferences affect larger
numbers of students than traditional affirmative action programs for
minority students, yet they have received a small fraction of the
attention. Unlike the issue of racial preferences, advantages for
alumni children — who are overwhelmingly white and wealthy — have been
the subject of little scholarship, no state voter initiatives and no
Supreme Court decisions.

Among selective research universities, public and private, almost
three-quarters employ legacy preferences, as do the vast majority of
selective liberal arts colleges. Some admissions departments insist
they are used only as tie-breakers among deserving applicants. But
studies have shown that being the child of an alumnus adds the
equivalent of 160 SAT points to one's application (using the
traditional 400-to-1600-point scale, and not factoring in the new
writing section of the test) and increases one's chances of admission
by almost 20 percentage points.

At many selective schools, legacies make up 10 percent to 25 percent
of the student population. By contrast, at the California Institute of
Technology, which has no legacy preferences, only 1.5 percent of
students are the children of alumni.

Legacy preferences are often justified as a way of building loyalty
among alumni, sustaining tradition and increasing donations. But there
is no hard evidence to prove this. A study by Winnemac Consulting for
the Century Foundation found that from 1998 to 2007, at the nation's
top 100 national universities, if one controls for the wealth of
alumni, "there is no statistically significant evidence of a causal
relationship between legacy preference policies and total alumni
giving." Moreover, the study found that at the seven universities that
dropped legacy preferences during the time of the study, alumni giving
didn't decline.

Legacy preferences are "virtually unknown in the rest of the world,"
according to Daniel Golden, a former reporter for The Wall Street
Journal. The paradox is that while they are an American contrivance,
they are also un-American, standing in direct contradiction to Thomas
Jefferson's famous call to promote a "natural aristocracy" based on
"virtue and talent." The Old World nature of hereditary preferences
may explain why, in a 2004 poll by The Chronicle of Higher Education,
Americans opposed such preferences by 75 percent to 23 percent.

Legacy preferences may also be illegal. Although in 1976 a federal
court ruled in a passing mention that legacy preferences are
constitutional, the issue has never been properly litigated. Today,
new legal arguments have been advanced questioning legacy preferences
at both public and private universities.

Steve Shadowen and Sozi Tulante, two lawyers in private practice in
Pennsylvania, have argued forcefully that preferences violate the
equal protection clause of the 14th Amendment. While the amendment was
primarily aimed at prohibiting discrimination against blacks, it also
extends to what Justice Potter Stewart called "preferences based on
lineage." In the past, the Supreme Court has read the amendment to
prohibit laws that judge individuals on their parents' actions or
behaviors, such as those that punish children born out of wedlock.

Legacy preferences at private institutions may also violate the 1866
Civil Rights Act, which prohibits discrimination on the basis of
"ancestry" as well as race.

Affirmative action policies are controversial because they pit two
fundamental principles against each other — the anti-discrimination
principle, which says we should not classify people by ancestry, and
the anti-subordination principle, which says we must address a brutal
history of discrimination. Legacy preferences, by contrast, advance
neither principle — they simply classify individuals by bloodline.

Congress should outlaw alumni preferences at all universities and
colleges receiving federal financing, just as the Civil Rights Act of
1964 outlaws racial discrimination at them. Or lawmakers could limit
the tax deductibility of alumni donations at institutions that favor
legacy children on the principle that tax-deductible donations are not
supposed to enrich the giver. If legislators don't act, it will fall
to lawyers to bring suit to enforce the 14th Amendment and the 1866
Civil Rights Act and put an end to this form of discrimination in
higher education.

Dear friends

I am here in Vijayawada court for whole day today, and observed the entire process of delivering judgment in the Ayeshameera murder case. It is shame on our police, prosecutors and judiciary that all are colluded to protect the real culprits for the money and other political advantages.

In the morning judge Sri Sudha (Brahmin by caste) called Sathyambau in to the court hall and told him that the case proved against him, and asked him whether he wants death penalty or life sentence, then Sathyambau replied bravely her to hang him, if it is really proved that he is the real culprit. (As he was not at all involved in this case and not expected this kind of judgment form court) The cruel thing is that the prosecution lawyer Umadevi (Kapu by caste) behaved inhumanly at this time and argued that Sathyambau should be hanged

And the judge posted case for judgment after lunch, at 2:30pm at this time the defense lawyer P.Srinivas argued that according to the Supreme Court, death penalty is applicable in the rarest of the rare cases, but this is not that kind of case. He also argued that there is no evidence at all, except report from the forensic lab, even that cannot be believable as the director of the forensic lab Dr Venkanna who given forensic report in this case was caught hold by the anti corruption bureau police and remanded for the offence of taking bribe to give a false report. The forensic report in the Ayeshameera case also given by Dr Venkanna, which is not at all believable, he argued.

After hearing to the defense counsel the judge again posted it for judgment after 10 minutes, but she came to the bench after 1 hour and delivered judgment that the innocent dalit boy Sathyambau sentenced for life for offence under 302 of IPC and 10 years imprisonment for the offence under 376 IPC that is rape and also awarded Rs 1000 as fine, if he is unable to pay that amount, he has to be in the jail for another 6 months

Though there is no proper evidence against Sathyambau, and there are protests in all over state in favors of Sathyambau the police and court were influenced by the political lobbies and bend for money, and punished innocent dalit boy, to protect real culprits

This is a clear cut case of caste discrimination against dalits in general and Sathyambabu in particular; this is the time to raise our voice against the castiest judgment on innocent dalit boy Sathyambabu

So we have to take a series if activities in protest against the castiest judgment. And Punishing a innocent dalit boy

Share Bhopal: Police have arrested three young men for allegedly
gang-raping a minor and circulating their crime in an MMS here in
Madhya Pradesh.


However, three other accused in the crime, including the son of a
deputy collector, are on the run.


The 14-year-old Dalit minor would have silently suffered the trauma
and never lodged an FIR, had it not been for this MMS video of the
crime. The 6 men who allegedly raped her circulated the video and this
is how the matter came to light when the MMS reached the police.


The victim, whose name has not been revealed said, "I had come to
Mandla about eight months back to my relatives' place and had gone for
a dip in the Narmada when one of these boys offered me a lift on his
bike. Thereafter I was taken to jungle and raped in turn by all six of
them. They also filmed their act with their mobile phone and
threatened to show it to everyone if I told about the incident to
anyone."


Three of the suspects have been arrested, including the son of a head
constable. The other three including the son of a deputy collector are
absconding.


The police have also recovered the motorcycle used to pick up the
victim and the mobile phone on which the MMS video was captured.

GREATER NOIDA: Even as unprecedented security measures were put in
place in western Uttar Pradesh before the Ayodhya verdict, a dalit
woman was gang-raped and set on fire in Bulandshahr's Gulaoti area and
a dalit minor was gang-raped at gunpoint in neighbouring Greater
Noida.

The Bulandshahr victim sustained over 80% burn injuries. She has been
admitted to a hospital in the capital and doctors say chances of her
survival are bleak.

According to police sources, four persons abducted a woman from her
home in Lahogla locality in Gulaoti on Tuesday evening. The four
accused Saddam, Boora, Sajid and Majid are residents of two
neighbouring villages. They took the woman to a secluded field in a
village and raped her by turn.

Then, the four actually dropped the victim to her home threatening her
to not inform the police. She told them she would get them arrested.
Her younger sister had also been raped a few months ago.

Fearing imprisonment, the four men picked up a bottle of kerosene from
the victim's house, poured it on her and set her afire. Police
arrested two of the perpetrators, while two are absconding.

In the Gopalgarh area in Jewar in Greater Noida, a 15-year-old girl
had gone to the fields to relieve herself on Wednesday evening when
two Jat neighbours, Anuj Chowdhary and Lala, kidnapped her at
gunpoint. They raped her at a nearby secluded spot. Both the men are
absconding.

In another incident a 40-year-old dalit woman, who has five kids, was
raped by 20-year-old Yogesh in Palenda in Greater Noida. The accused
was known to the victim. The village panchayat gave her Rs 60,000 as
compensation and tried to hush up the incident. When the victim was
approached by police, she remained evasive.

Warm Greetings from the Balijan Cultural Movement, a cultural rights
organization of the Dalit-Bahujans that networks with Christian
Buddhist, Sikh, Muslim and other minority organizations.
As it is well known that President Barack Obama and his wife Michelle
Obama are going to visit India in early November. It is also well
known that he will be the first black President to come to India with
his full official delegation in order to strengthen the Indo-US
relations.
It is customary that all official foreign dignitaries pay homage to
Mahatma Gandhi, the father of Indian nation and we as Balijan Cultural
Movement would like to request UPA leaders to take the initiative to
include a visit of President Obama to Dr BR Ambedkar's Deeksha Bhoomi
at Nagpur for two major reasons. Ambedkar represents a major
historical civil rights movement for abolition of untouchability and
caste like the one led by Dr. Martin Luther King Jr.for black
liberation in America.
Since you as a young leader of the nation taking interest in Dalit and
Tribal liberation, Obama's homage to Ambedkar will have major soothing
effect on all the oppressed communities of the nation. The second
reason is that Ambedkar being a Buddhist and social reformer all the
minorities own his heritage. Such a step will also have a major impact
on Muslim minorities too because they also treat Ambedkar as a
minority leader.

20-year-old Dalit girl of Lahugala locality. When the girl threatened
to report the case to the police, the accused poured kerosene on her
and set her on fire. The accused were identified as Saddam, Bhura,
Sazid and Mazid.

She was taken to a local hospital from where she was referred to
Safdarjung Hospital in Delhi. She is critical with 90 percent burns.

In another incident, Anuj Chaudhary and Lala - two locals of Gopalgarh
locality in Greater Noida - gangraped a 15-year-old Dalit girl at
gun-point when she went to relieve herself in an agricultural field.
